TERMS AND CONDITIONS
Joining the WAffiliates Program
1. You must submit a completed application through WAffiliates.ag website in order to join our affiliate program. One of our Affiliate Managers will review your application and respond within 24 to 48 hours.
2. By completing your application at WAffiliates.ag, you will be asked to provide a complete list of the domain names you intend to use for the marketing of our program (‘Proposed Domain Names’) and at our request, you must provide detailed information about these name(s), which include, but not limited to, their quality, content and design. Once your application is accepted, the proposed domain names that you provide are the domains in which you are authorized by this program to promote the participating sites (‘accepted sites’).
3. By submitting your application, you declare that you are over the legal age of your jurisdiction and that your domain is not designed to attract minors.
4. The personal information you provide must be accurate, complete and authentic.
5. An Affiliate must not open more than one Affiliate account without the prior written consent of the Company, nor will an Affiliate earn commissions from his own player account. Affiliates are not allowed to bet using their Affiliate account. In the event that an Affiliate wishes to play on WagerStreet.net, Affiliate must set up a separate player account on WagerStreet.net. If an Affiliate wishes to test the system, the Company will provide the Affiliate with a demo account to access our platform. In the case of a violation, the Company has the right to void all applicable earned commissions from such account. For the avoidance of doubt, any personal player account on WAffiliates.ag website, said Affiliate must set up a separate player account on the WAffiliates.ag website. If an Affiliate wishes to test the system, the Company will provide the Affiliate with a demo account to access our platform. In the case of a violation, the Company has the right to void all applicable earned commissions from such account. For the avoidance of doubt, any personal player account on WAffiliates.ag website should not be directly linked to an Affiliate account.
6. Affiliates are only allowed to have 1 account per IP (household).
7. After registering each affiliate will receive a welcome letter with the new username and password.
8. An Affiliate will not establish any domain of Facebook, Twitter or other social network, blog domain, profile name or name to display that contains names, words and phrases that are part of WAffiliates.ag, WagerAffiliates.ag, or WagerStreet.net
9. An Affiliate is prohibited from purchasing or creating off-site text links with anchor text for keyword phrases, names, words and phrases that are part of WAffiliates or any of its brands.
Advertising of your Affiliation with WAffiliates
1. To promote our brands, we will provide the affiliate with access to a link generator, co-branded banners, XML odds feeds, tracking tools, and all the necessary material to achieve the promotion. The affiliate cannot modify the links obtained from us without prior written authorization.
2. WAffiliates will grant the affiliate a non-exclusive, non-transferable, non sublicensable, revocable right to use WAffiliates Logos and text solely for the purpose of the affiliate program.
3. The affiliate will be responsible only for the development, operation, and maintenance of his/her web site (s).
4. Banners provided by WAffiliates are hosted on our servers and we reserve the right to update these banners at any time and without previous notice.
5. We reserve the right to monitor all websites promoting WAffiliates in order to determine if you are in compliance with our terms and conditions and consequently, take the proper actions at our discretion.
6. Affiliates should use best marketing reasonable efforts to actively and effectively advertise, market and promote WAffiliates as widely and aggressively as possible in order to maximize the financial benefit for both, affiliate and WAffiliates program.
7. The Brands that you promote for WAffiliates will handle a Sales and Retention Team that will optimize conversions of your players so you can make the most of your traffic.
8. Players must be properly tagged to an Affiliate´s account. Should this tag be improperly inserted or the steps not followed correctly, the player registration and commission will not be assigned to you.
9. WAffiliates reserves the right to refuse players or end the contract with them if necessary to comply with WagerStreet.net terms and conditions. We will not be responsible for any indirect, special, or consequential damages or losses incurred by the affiliate or a customer referred by the affiliate, arising in connection with this agreement or the affiliate program.
10. WAffiliates will not be responsible for any contest or promotion not authorized by our affiliate Department.
11. You will be solely responsible for the technical operation of your website and the accuracy and appropriateness of materials posted in it. You agree that neither your website or social media accounts and pages or any kind will not, in any way, copy or resemble the look and feel of our website or Participating Sites, nor will You create the impression that Your Site is Ours.
12. Affiliates cannot use anchor text for keyword phrases, names or words that are or can be deemed to resemble our brands.
13. Affiliates may not purchase or register keywords or search terms for use in any search engine, portal, sponsored advertising service or referral services which are WagerStreet Sportsbook trademarks including the words “WagerStreet” “WAffiliates” or any variations thereof. WAffiliates reserves the right to close your Affiliate account retaining all revenue generated from these keywords.
Confidentiality
1. All information, including without limitation, the business and financial information, customer and supplier lists, pricing and sales information, concerning WAffiliates.ag and its affiliate program or any of our Affiliates shall remain strictly confidential and secret. It should not be utilized, directly or indirectly, for your own business purposes.
Term and Termination
1. The term of this Agreement with WAffiliates.ag program will begin when You complete the sign-up procedure and have been informed by Us of Your acceptance to the Program and create a unique link to Our sites and will be continuous unless and until either party decides to terminate this agreement for any cause given or not given.
2. The party must notify the other in writing or any means of communication that it wishes to terminate the Agreement, in which case this Agreement will be terminated immediately. TERMINATION IS AT WILL, WITH OR WITHOUT REASON, BY EITHER PARTY. For purposes of notification of termination, delivery via e-mail to info@waffiliates.ag program will begin when You complete the sign-up procedure and have been informed by Us of Your acceptance to the Program and create a unique link to Our sites and will be continuous unless and until either party decides to terminate this agreement for any cause given or not given.
3. If the Agreement is terminated pursuant to clause mention before, the Affiliate will be entitled to unpaid Commissions if any, earned by or on the date of termination. For the avoidance of doubt, no Commissions occurring after the date of termination will be paid.
Spam Policy
1. As an Affiliate, you agree to comply with the requirements of the CAN-SPAM Act of 2003 in its distribution of email that contains messaging regarding the Participating Sites. Furthermore, you agree that all promotional work You do with Us will comply with industry acceptable standards. Any unacceptable activity (including the use of spam) will be cause for immediate termination of this agreement.
Unsuitable Sites
1. We may terminate this Agreement if we determine (in our sole discretion) that your site is unsuitable. Unsuitable sites include, but are not limited to, those that: are aimed at children, display pornography or other illegal sexual acts, promote violence, promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, gender or age, promote illegal activities or violate intellectual property rights or breach any relevant advertising regulations or codes of practice.
Cookies
1. If a player clicks a link from an affiliate tracking code, it will generate a cookie for the next 30 days. If in those 30 days, the person creates an account, it will be associated to the affiliate tracking link for the user.
2. The last cookie that tracks a visitor before opening an account will be the one accounted to the affiliate.
Referred Players
1. It is prohibited for you and your relatives such as spouse, partner, parent, child or sibling, or any individual using same IP address (household) to be referred to WAffiliates.
2. You will be able to keep track of your referred players, activity generated, commissions and the payments you are entitled to receive through our Affiliate website. You will be able to review these statistics with ease and be able to improve your promoting campaigns or keep track of them.
3. Affiliate shall not be entitled to the percentages retrospectively, notwithstanding their reinstatement.
4. Affiliates can earn on active players only. Players must be active during the month to trigger commission for the affiliate. Player’s activity will be reviewed on a case-by-case basis.
5. It is your responsibility to keep your affiliate login and password secure. We are not responsible for any losses that may arise from anyone accessing your Affiliate account.
6. In the unlikely event that two or more affiliates claim referral over player/s, it will be up to our management to make a final decision as to who gets the player referral
7. We reserve the right to withhold affiliate payment/s generated by any Affiliate player/s that are under investigation. We reserve the right to refuse customers or to close their accounts at manager’s discretion.
Account Balance
1. The account balance is a figure that shows Rev Share, Debit Adjustments and Commission Payouts combined. If the account balance is positive commissions can be collected, if account balance is negative means no commissions can be collected until is positive again.
2. Earnings column will display within the system as (positive/negative) and send the correct percentage to the account balance including administrative adjustments.
3. Affiliates can confirm earnings by checking the complete Net Revenue column and calculate earnings by the affiliate’s percentage deal.
Commissions
1. WAffiliates will pay the affiliate a commission based on the players’ net losses. These players must have signed up through your Affiliate website or tracking ID or provided us with the affiliate promotion code.
2. Net losses are calculated from: Sportsbook/Casino/Horse Betting activities
3. Program will pay out revenue share on the commissionable earnings generated by each customer, as defined by the merchant.
4. Chargeback Policy. Since Chargebacks directly affect the accumulated Net Revenue received by Us, it affects your commission payment as well. If a Referred Player disputes a transaction which eventually results in a chargeback, the accumulated revenue generated by yourself will be reduced by the chargeback figure up to the amount of commissions received.
5. The Company reserves right to offer different commission structures and revenue models in respect of different affiliate partners. We may raise or lower any affiliates’ commissions’ accounting to our step-tier-base commission scale and method of calculation of your referral commission at management’s discretion.
6. Commissions will be calculated from the previous calendar month and commissions will be settled by the 10th of the new calendar month.
7. If your Revenue Share is negative for any particular month resulting in a negative Commission, your negative Revenue shall be carried forward to the subsequent months(s).
8. We retain the right to change the Referral Commission percentage and method of calculation of Referral Commission at management’s discretion.
9. Our affiliates could have a negative carry-over figure on players if net win is higher than net loses as commissions are based on net losses.
10. Inactive Affiliates who do not bring in a new FTD (First Time Depositor) in the previous 6 months (180 days) will still receive a commission, however, the percentage will be brought down to a minimum of 10% until a new FTD is reached by the account.
11. If you desire to offer extra incentives to potential referred players, you are required to receive our written approval; otherwise, commissions generated by such unauthorized incentive will be void.
12. It is required for the referred player to make a real money deposit in order for the Affiliate to receive commissions over his/her net losses.
13. Any Earnings on referred bonuses or betting adjustments made to a players account will not be taken into consideration for commissions.
14. In case fraudulent activity is detected by the referred player or the Affiliate, we reserve the right to terminate this agreement and hold any commission generated through fraud at our own discretion.
15. You are urged to provide accurate details in regard to the manner and information relating to your preferred method of receiving payments. WAffiliates shall not be held liable for your delayed receipt of commissions due to your provision of inaccurate details. It is your responsibility to be aware of money owed and commissions received. We will always update you with commissions sent, but after One month it will automatically be presumed that the money sent was received, and will no longer be traced.
Payouts
1. Affiliates can request their payouts after the 15th of each month, via email to info@waffiliates.ag. A Crypto address must be included within the email, matching the address on the profile record, payouts will only be considered if the request comes from the affiliate’s main profile email. Any email/address change needs to be done through the affiliate’s personal profile.
2. Affiliates can cash out using the following payout methods:

2.2. USDT
2.3. Bank Wire (Over $25,000)
3. Affiliate payments will be processed when the amount is equal or larger than $200. If an Affiliate’s Commissions monthly earnings are larger than $5,000 USD, multiple payments can be processed. However, the affiliate must provide multiple unique BTC addresses.
4. All amounts are calculated and paid in accordance with the Company’s reasonable and good faith means of statistical analysis and customer tracking methods. An Affiliate agrees that the statistical analysis of the affiliate program and client tracking methods are accurate and reasonable, and their calculations are final.
5. If an Affiliate Player is being investigated for credit card, bank information or address verification, the Company will withhold payment of Commissions earned by the Affiliate in respect of revenues generated by such Affiliate Player until the investigation is completed.
Fees
1. WAffiliates is not responsible for commission fees generated from referrals with incorrect or incomplete referral information. CCPP – Credit Card Processing Payment fees will apply depending on Affiliate commission structure.
Jurisdictions of Law
1. The Agreement, and an Affiliate’s relationship with the Company under the Agreement, shall be governed by the laws of the Costa Rica, without regard to its conflict of laws provisions whose courts shall be the non-exclusive courts of competent jurisdiction. Notwithstanding this, the Affiliate agrees that the Company shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction
2. The laws of the Costa Rica will govern this Agreement without reference to rules governing choice of laws. You hereby submit to the jurisdiction of the Courts located in Costa Rica with respect to any dispute, claim or other matters arising under this Agreement and the Courts of Costa Rica shall have non-exclusive jurisdiction with respect to any such dispute, claim or other matters. However, nothing herein prevents Top Affiliates from proceeding against you in courts of any other jurisdiction.
Entire Agreement
1. We may modify the Terms and Conditions at any time and at our sole discretion and without prior notice.
2. All Affiliate terms and rules apply to Master Accounts as well.
3. Reserves the right to terminate this agreement at our sole discretion; consequently, the Affiliate must remove all our banners, links and any other content.
4. You agree to this terms and conditions by clicking the “Submit” button on our Affiliate Registration Form herein attached.
5. An Affiliate may not apply to or participate in the Program unless they accept the Terms.
6. You are not authorized to use any software such as spiders, algorithms or bots to crawl, page-scrape or access any of our brand’s websites or affiliate program websites.
7. IP’s, which are not authorized to use our XML feeds, API feeds, server to server information, shall be authorized or blocked at our discretion. Whitelisting is completed upon request.
8. Affiliates must ensure that any materials such as banners on your website site are not violating copyright or Intellectual property.
9. We are not responsible for lost or injury caused by negligent use of our creative or our links, be dated or outdated.
10. We will not be liable for interruptions or errors caused by our websites and systems.
11. We may modify any of the terms and conditions contained in this Agreement at any time and in our sole discretion. It is the Affiliate’s responsibility to periodically check these terms and conditions, if an Affiliates continues to participate in the Program after the date on which the Terms have changed, it will affirm that you have accepted the updated Terms. If any modification is unacceptable, your only recourse is to terminate this Agreement; should you so terminate the changes we have announced shall nevertheless become effective unless we agree, in writing to info@waffiliates.ag, to the contrary. Your continued participation in the Program following our posting of a change notice or new Agreement on Our Site will constitute binding acceptance of the change.
12. You acknowledge that you have read this agreement and agree to all of its terms and conditions. You understand that we may at any time without prior notice (directly or indirectly) solicit customer referrals on terms that may differ from those that are contained in this agreement or operate similar websites that compete with your site. You have independently evaluated the desirability of participating in our affiliate program and are not relying any representation, guarantee, or statement or other than as set forth in this agreement. We will not recognize modifications of this agreement
13. We make no representation that the operation of the WAffiliates.ag Web site will be uninterrupted or error-free and we will not be liable for the consequences of any interruptions or errors.
14. The WAffiliates program is intended for your direct participation. You shall not open affiliate accounts on behalf of other participants. Opening an affiliate account for a third party, brokering an affiliate account or the transfer of an affiliate account is not accepted.
15. Affiliates wishing to transfer an account to another beneficial account owner must request permission to do so by Contacting Us. Approval is solely at management’s discretion.
